Partner Programme Terms & Conditions

These Partner Programme Terms & Conditions ("Programme Terms") govern your participation in the EQON Installer Partner Programme. These terms cover the operational structure of the programme, including tier levels, benefits, bonus calculations, and how we process your data. For rules specific to the annual competition and prizes, please see the separate Competition Rules document.

By signing up for the Partner Programme, you acknowledge and accept these Terms. These Terms may be updated from time to time. Updated versions will be published on eqon.com, and significant changes will be notified to you.

1. Definitions

"Partner" or "You" means any installer company that has signed up for the EQON Installer Partner Programme.

"EQON" or "We" means EQON AS, registered in Norway, operator of the Partner Programme.

"EQON Online" means EQON's cloud-based SaaS platform for monitoring, managing, and operating heat trace systems.

"Installation(s)" or "Registered Installation(s)" means EQON TC32 heat trace controllers installed by the Partner and registered through EQON Online.

"Tier" means the Partner Programme membership level (Certified, Expert, or Master) determined by the number of Installations registered in a rolling 12-month period.

"Personal Data" means any information relating to you that can be identified, including your name, email address, phone number, company details, bank account information, and Installation records.

2. Partner Programme Structure

Partners are assigned to one of three tiers based on the number of Installations registered through EQON Online over a rolling 12-month period.

2.1 Tier Levels and Benefits

EQON Certified (1–9 Installations per 12 months)

  • Per-unit bonus: 500 NOK per Installation, paid quarterly
  • Full access to EQON training and sales materials
  • Priority technical support
  • Eligibility for monthly prize giveaways and the annual competition

EQON Expert (10–49 Installations per 12 months)

  • Per-unit bonus: 600 NOK per Installation, paid quarterly
  • Full access to EQON training and sales materials
  • Early access to preview new product features
  • Eligibility for monthly prize giveaways and the annual competition

EQON Master (50+ Installations per 12 months)

  • Per-unit bonus: 1,000 NOK per Installation, paid quarterly
  • Full access to EQON training and sales materials
  • Early access to preview new product features
  • Eligibility for monthly prize giveaways and the annual competition

2.2 Tier Determination

Your tier is determined by the total number of Installations registered through EQON Online in a rolling 12-month period. Tier status changes automatically as your Installation count changes.

3. Financial Incentives

Per-unit bonuses are calculated based on your tier status at the time of payment. Bonuses are calculated and paid quarterly (every 3 months) based on Installations registered and confirmed in EQON Online. Payment will be made via bank transfer to the account details you provide.

4. Monthly Prize Giveaways

All Partners, regardless of tier, are eligible to win monthly prize giveaways. These include workwear, tools, electronics, experience vouchers, and other promotional items. Monthly prize draws are conducted by EQON. The specific prizes and values are announced monthly via the EQON Online partner portal and are subject to change at EQON's discretion.

5. Training, Support & Marketing

All Partners at every tier receive full access to EQON training and sales materials. This includes technical training modules, installation guides, customer-facing sales materials, case studies, and reference projects. Materials are accessed through the EQON Online partner portal.

6. Leaderboard & System of Record

A live national leaderboard showing each Partner's Installation count is available via EQON Online and updated in real time. This leaderboard serves as the official record for tier determination and competition standings. All disputes regardingInstallation counts will be resolved by reference to the EQON system of record, which is final.

7. Modifications to the Programme

EQON reserves the right to modify these Programme Terms, tier structure, per-unit bonuses, benefits, and monthly prize offerings at any time. Changes will be published on eqon.com. Significant modifications will be communicated in writing at least 30 days in advance.

EQON will not retroactively reduce bonuses that have already been earned and due. Any bonus reduction affecting future earnings will be announced with a minimum 30-day notice period.

8. Termination & Withdrawal

Partners may withdraw from the Programme at any time by notifying EQON in writing at partners@eqon.com. Upon withdrawal, you remain entitled to bonus payments for all Installations registered prior to the withdrawal date. You will no longer be eligible for future bonuses or competition prizes.

EQON may suspend or terminate a Partner's participation if the Partner violates these Terms or engages in fraudulent conduct related to Installation registration.

9. Data Processing & Privacy

9.1 Data Collection & Use

By signing up for the Partner Programme, you provide us with personal and business data, including:

  • Your name, work email address, and phone number
  • Your company name and any company details you provide
  • Bank account details for bonus payment processing
  • Installation records registered through EQON Online
  • Your tier status, bonus payment history, and competition standings

We use this data to:

  • Administer your Partner Programme membership and tier status
  • Calculate and process quarterly bonus payments
  • Track your Installation count and determine competition standings
  • Send you required programme communications and monthly prize updates
  • Maintain and display the live leaderboard visible to all Partners
  • Comply with Norwegian accounting and tax requirements

9.2 Legal Basis for Processing

We process your data on the following legal bases under GDPR Article 6:

a) Your Consent: For communications (programme updates, competition standings, monthly announcements) and marketing communications (if you opted in during sign-up).

b) Contractual Necessity: For data we need to fulfil the Partner Programme contract with you, including your Installation count, bonus calculations, tier determination, and payment processing.

c) Legal Obligation: For tax and accounting records related to bonus payments (Norwegian law requires 6-year retention of payment records for tax purposes).

9.3 Data Retention

We retain your Personal Data as follows:

  • Signup data (name, email, phone): Duration of partnership + 3 years (for tax record purposes)
  • Bonus payment records: 6 years (required by Norwegian tax law)
  • Installation records: While you are an active Partner and for 3 years after termination
  • Marketing and communications preferences: Until you withdraw consent or 2 years of inactivity
  • Competition leaderboard data (current year): Published to all Partners during the competition year

9.4 Who Has Access to Your Data

  • EQON staff: Access to your signup data and payment information for programme administration and bonus payment processing
  • All Partners: Access to your company name and Installation count (visible on the live leaderboard during the competition year)
  • Third parties: Bank details shared only with our payment processor for bonus payment processing; no marketing, competitive, or Installation data is shared with third parties

9.5 Your Data Rights

Under GDPR, you have the following rights regarding your Personal Data:

Right to Access: Request a copy of the Personal Data we hold about you by emailing partners@eqon.com.

Right to Rectification: Correct inaccurate data in EQON Online or by emailing partners@eqon.com.

Right to Erasure: Request deletion of your data, subject to our retention obligations for tax records (6-year retention for bonus payments) and ongoing contract performance.

Right to Restrict Processing: Ask us to limit how we use your data (e.g., no marketing, but still process programme administration data).

Right to Data Portability: Request your data in a structured format (CSV) for export to another system by emailing partners@eqon.com.

Right to Withdraw Consent: Withdraw consent for communications and marketing at any time by emailing partners@eqon.com. Withdrawal does not affect data processing that occurred before the withdrawal.

Right to Object: Object to our processing of your data for specific purposes. EQON will respond to objections within 30 days.

9.6 Leaderboard & Public Data

Your Installation count and company name are displayed on the live leaderboard visible to all Partners during the competition year. This is essential to the operation of the competition. By accepting these terms, you consent to your Installation count and company name being displayed on the leaderboard.

If you do not wish your company name to appear on the leaderboard, you must contact partners@eqon.com before your first Installation is registered. In this case, we will display your Installation count anonymously (e.g., "Company #1234").

9.7 Data Security

EQON implements appropriate technical and organisational security measures to protect your Personal Data against unauthorised access, alteration, or loss. However, no security measure is 100% guaranteed. If we become aware of a data breach that could affect you, we will notify you without undue delay and within 72 hours in accordance with GDPR Article 33.

9.8 Changes to This Section

If we materially change how we process your Personal Data (e.g., we start using a new payment processor, sharing data with new third parties, or changing data retention periods), we will notify you in writing at least 30 days in advance. Continued participation in the Partner Programme after such notice constitutes acceptance of the new data processing terms.

9.9 GDPR Compliance & Contact

You also have the right to lodge a complaint with the Norwegian Data Protection Authority (Datatilsynet) at datatilsynet.no if you believe EQON is not processing your Personal Data in accordance with GDPR.

10. Liability & Disclaimers

EQON shall not be liable for technical failures in EQON Online that may affect leaderboard updates or Installation registration, provided EQON makes reasonable efforts to maintain system integrity. Bonuses and competition prizes are provided on an "as-is" basis.

11. Governing Law

These Programme Terms are governed by Norwegian law.

EQON Partner Competition

Rules & Mechanics

These Competition Rules ("Competition Rules") govern participation in the EQON Season Competition, which runs on a calendar-year basis and awards prizes to top-performing Partners. These rules are separate from and supplementary to the Partner Programme Terms & Conditions. In case of conflict, the Competition Rules take precedence regarding competition-specific matters.

1. Competition Overview

The EQON Season Competition is an annual programme running from 1 January through 31 December 2026. All Partners in the EQON Installer Partner Programme are automatically eligible to participate. The competition determines which Partners receive monthly giveaway prizes and the exclusive VIP trip prize awarded to the top-3 performers, as well as a single “Golden Ticket” randomly assigned to one EQON partner.  

2. Eligibility

To participate in the competition, you must:

  • Be registered and approved as a Partner in the EQON Installer Partner Programme
  • Have registered at least one Installation in EQON Online during the competition period, or be registered and approved as an EQON Partner and win the randomly assigned “Golden Ticket”  
  • Comply with these Competition Rules and the Partner Programme Terms & Conditions

3. Competition Standings

3.1 Measurement & Leaderboard

Competition standings are determined solely by the total number of Installations registered through EQON Online during the calendar year (1 January – 31 December 2026). A live national leaderboard updated in real time shows each Partner's current standing and is accessible via EQON Online. One winner will also be randomly assigned to a partner in the form of a “Golden Ticket” and selected out of all installers in the EQON Partner Program.

3.2 System of Record

The EQON Online system is the authoritative source for all competition data, including Installation counts, leaderboard standings, and final rankings. The EQON system of record is final and conclusive. All disputes regarding Installation counts or standings will be resolved by reference to this system and cannot be appealed.

4. Monthly Prize Giveaways

4.1 Eligibility & Mechanics

All Partners with at least one registered Installation in the competition calendar year are eligible for monthly prize giveaways. Winners are selected at random from the eligible Partner pool. There is no minimum threshold to enter the monthly draw.

4.2 Monthly Prize Offerings

Monthly prizes are promotional items including but not limited to: workwear, tools, electronics, experience vouchers, and other branded merchandise. The specific prizes and estimated values are announced on the EQON Online partner portal. Prize values may vary month to month. EQON reserves the right to substitute alternative prizes of equivalent value at its discretion.

5. Annual VIP Trip Prize

5.1 Award & Eligibility

The top-3 Partners by total Installations registered during calendar year 2026 are each awarded an exclusive, all-expenses-paid VIP experiential trip to a major football event in 2027. This prize is automatically awarded to the three Partners with the highest Installation counts at the end of the calendar year. Tier status does not affect eligibility — all Partners, regardless of tier, compete equally based on total Installations.

5.2 VIP Trip Package Contents

Each VIP trip package will be delivered by a certified hospitality provider, and includes the following for 1 individual nominated by the Partner:

  • Return flights from Norway to the final destination
  • Hotel accommodation  
  • Ground transportation (airport, hotel, venue)
  • Match tickets  
  • Meals and hospitality

5.3 Trip Confirmation & Logistics

The specific final event, destination, and travel dates will be confirmed by EQON by 30 April 2027. Winners will be notified by email within 5 business days of final standings being confirmed. Any dietary restrictions, mobility requirements, or travel preferences must be communicated to EQON in writing within 14 days of prize notification. EQON will coordinate all travel and accommodation logistics. Winners are responsible for obtaining valid travel documentation (passports, visas).

5.4 Prize Substitution

If the specified final event cannot be delivered due to unforeseen circumstances beyond EQON's reasonable control, EQON reserves the right to substitute an alternative sporting event. EQON will notify winners of any substitution as soon as practicable.

6. Final Standings & Tie-Breaking

Final competition standings are determined at 23:59 CET on 31 December 2026. In the event of a tie in Installation count, the Partner who first achieved that Installation count will rank higher. If an exact timestamp cannot be determined, EQON will review system logs to determine the earliest registration time. The EQON system of record is final.

7. Disputes & Complaints

If you believe there is an error in the leaderboard or your Installation count, you must notify EQON in writing at partners@eqon.com within 5 business days of the issue occurring. Include the specific Installation(s) in question and supporting documentation. EQON will review and provide a response within 10 business days. Decisions made by EQON regarding disputed Installations are final.

8. Prohibited Conduct

Partners shall not:

  • Fraudulently register installations that were not performed
  • Manipulate or interfere with the EQON Online system or leaderboard
  • Attempt to gain unauthorised access to competition data or systems
  • Collude with other Partners to artificially inflate standings or manipulate outcomes

Any Partner found to have engaged in prohibited conduct will be immediately disqualified from the competition and may have their Partner programme membership terminated. EQON will not award prizes to disqualified Partners.

9. Liability & Disclaimers

EQON shall not be liable for:

  • Technical failures or delays in the EQON Online system
  • Failure to record or confirm Installations due to technical issues, provided EQON makes reasonable efforts to maintain system integrity
  • Winners' inability to participate in the VIP trip due to travel restrictions, visa denial, or personal circumstances
  • Changes in event venue, date, or cancellation beyond EQON's reasonable control

All prizes are provided "as-is" without warranty. Participation in the competition and acceptance of prizes constitutes acknowledgment that you understand and accept these terms and the associated risks.

10. Modifications to Competition Rules

EQON may modify these Competition Rules at any time. Modifications will be published on eqon.com.  

11. Governing Law

These Competition Rules are governed by Norwegian law.
